Residents are only allowed to use fireworks (not explosive fireworks or firecrackers) and purchase fireworks from organizations and businesses authorized to produce and trade in fireworks.
How to Legally Use Fireworks?
Decree No. 137 of the Government regulates the management and use of fireworks, allowing citizens to use fireworks during certain events such as: festivals, holidays, birthdays, weddings, conferences, inaugurations, anniversaries, and in cultural and artistic activities.
However, citizens can only purchase fireworks from organizations and businesses that have been granted certificates of eligibility for fireworks trading.

Currently, there are two types of fireworks: explosive fireworks and display fireworks. The types of fireworks that are prohibited include explosive fireworks and fireworks that create explosions.
- Explosive fireworks are those that, upon impact from physical, thermal, chemical, or electrical stimuli, produce noise or create whistling sounds, explosions, and color effects in the space.
- Display fireworks contain explosive substances, and when used, produce whistling sounds, explosions, and color effects in the space.
The type of fireworks that is allowed for use is display fireworks. This product is manufactured either handmade or industrially, and when stimulated by physical, thermal, chemical, or electrical inputs, it generates sound, light, and color effects in space without causing explosions.
Can Citizens Purchase Fireworks from the Ministry of National Defense for Sale?
According to the Ministry of Public Security, based on Decree No. 137 of the Government regarding the management and use of fireworks, Article 5, Clause 1 clearly states prohibited acts, including:
Researching, creating, and producing explosive fireworks; buying, selling, exporting, and importing explosive fireworks; storing, transporting, using, or misappropriating explosive fireworks. Except for organizations and businesses under the Ministry of National Defense that are assigned by the Prime Minister to research, produce, import, export, supply, transport, and use explosive fireworks according to regulations.
Additionally, the conditions for trading fireworks are stipulated in Clause 2, Article 14 of Decree No. 137 as follows: Only organizations and businesses under the Ministry of National Defense are allowed to trade fireworks, and they must be certified by the competent police authority regarding security and order; ensuring conditions for fire prevention, firefighting, emergency response, and environmental protection.

Moreover, the warehouses, transportation means, equipment, and tools for fireworks trading must meet the requirements for storage, transportation, fire prevention, and firefighting.
Individuals managing or serving in fireworks trading must be trained in safety techniques. Notably, only fireworks that meet technical standards and regulations are allowed for trade.
Thus, based on the above regulations, it is clear that individual citizens are not permitted to trade fireworks from the Ministry of National Defense; only organizations and businesses under the Ministry of National Defense are allowed to trade fireworks and must meet all conditions as stated above.
Individuals engaging in illegal firework sales during the Lunar New Year may face administrative fines ranging from 2 to 5 million VND; confiscation of illegal items and means of violation, and may be required to return any illicit profits obtained from the illegal sale of fireworks.
The Ministry of Public Security also adds that, as of now, only the One-Member Limited Liability Company 21 Chemicals (Z121 Factory) under the Ministry of National Defense is authorized to produce and supply fireworks.
Therefore, residents must purchase fireworks from the Z121 Factory, which has been issued a license and certification from the Ministry of National Defense, to ensure they are legally allowed to use them. Residents can also buy fireworks at authorized sales points for the Ministry of National Defense fireworks in 2024, located in Hanoi, Ho Chi Minh City, and other provinces.
